Unlawful Internet Gambling Enforcement Act Upheld By Federal Court

The 3rd Circuit Court of Appeals court in the USA has rejected a claim by the Interactive Media Entertainment & Gaming Association that current anti USA online casino gambling laws are too vague and intrusive to be constitutional.

One of the arguments that iMEGA focused on was that the UIGEA violated privacy rights. The online casino gambling trade associate cited two cases which were Lawrence v. Texas and Reliable Consultants Inc. v. Earle -- as examples of how the UIGEA infringed on privacy.

The good news is that the ruling offers a slightly new interpretation that may allow individual states to create their own online gambling laws. As we’ve seen in recent weeks, some tribes and card clubs in California are trying to do just that, so this could be the beginning of a new trend to legalize and regulate gaming state-by-state.

The down side, that would of course lead to a whole new world of red tape and regulatory headaches. Still, it would be better than a strictly illegal environment, which the US online gambling is experiencing due to the 2006 Unlawful Internet Gambling Enforcement Act (UIGEA).

Joe Brennan Jr., iMEGA’s Chairman, stated that "The court made it clear - gambling on the Internet is unlawful where state law says so. But there are only a half-dozen states which have laws against Internet gambling, leaving 44 states where it is potentially lawful. It's not perfect, but it's a good start."
